These Terms of Service govern your use of our fishing charter services and website. By booking a charter or using our services, you agree to these terms. Please read them carefully.
1. Booking and Reservations
All bookings are subject to availability and confirmation. A deposit or full payment may be required to secure your reservation. Bookings are confirmed only after payment is received and you receive a confirmation from us.
You are responsible for providing accurate contact information and party details when making a reservation. Any changes to your booking should be communicated to us as soon as possible.
2. Cancellation Policy
Cancellations made within the specified cancellation window (as communicated at booking) may result in forfeiture of your deposit or payment. We understand that plans change and will work with you to reschedule when possible.
Weather-related cancellations initiated by the captain for safety reasons will result in a full refund or the option to reschedule. We reserve the right to cancel or reschedule trips due to unsafe weather conditions, mechanical issues, or other circumstances beyond our control.
3. Guest Responsibilities
All guests must follow the captain's instructions at all times for safety and proper conduct aboard the vessel. You are responsible for:
- Arriving on time for your scheduled charter
- Possessing any required fishing licenses
- Ensuring all members of your party are physically capable of participating
- Disclosing any medical conditions that may affect participation
- Following all safety regulations and instructions
- Respecting the vessel, equipment, and marine environment
4. Safety and Conduct
Your safety is our top priority. The captain has final authority on all decisions related to vessel operation and guest conduct. Guests who are intoxicated, unruly, or who refuse to follow safety instructions may be refused service without refund.
We provide safety equipment including life jackets. You are required to wear safety equipment as directed by the captain. Children must be supervised by adults at all times.
5. Liability and Assumption of Risk
Fishing and boating activities involve inherent risks. By participating in our charters, you acknowledge and assume these risks. While we maintain appropriate insurance and safety measures, you agree to participate at your own risk.
We are not liable for personal injuries, property damage, or loss of personal belongings unless caused by our gross negligence. You are encouraged to obtain travel and health insurance for your trip.
6. Fishing and Catch
We cannot guarantee specific catches or fishing results as these are dependent on natural conditions. All fishing activities are subject to federal, state, and local regulations. Size and bag limits apply and will be enforced.
Guests are welcome to keep legal catches within regulations. We promote catch-and-release practices for conservation when appropriate.
7. Equipment and Property
We provide fishing equipment, tackle, and bait as part of your charter. You are responsible for any damage to equipment or the vessel caused by negligence or misuse.
Personal belongings brought aboard are your responsibility. We recommend leaving valuables at home and bringing only necessary items.
8. Photography and Media
We may take photographs or videos during your charter for marketing purposes. By participating, you grant us permission to use such media. If you prefer not to be photographed, please inform us before your trip.
9. Gratuities
Gratuities for the captain and crew are not included in the charter rate but are greatly appreciated for excellent service. Industry standard is 15-20% of the charter cost.
10. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Your continued use of our services after changes indicates acceptance of the modified terms.
11. Governing Law
These terms are governed by the laws of the State of Florida. Any disputes arising from these terms or your use of our services will be resolved in the courts of Florida.
